About L1 & L2 Visas

L-1 Visa: Intracompany Transferee

  • Eligibility Requirements:

    • Employer Criteria: The U.S. company must have a qualifying relationship (parent, branch, affiliate, or subsidiary) with a foreign company and be actively conducting business.
    • Employee Criteria: The employee must have worked for the foreign company for at least one continuous year within the past three years in an executive, managerial, or specialized knowledge capacity.

    • L-1A: For executives and managers, valid for up to 7 years.
    • L-1B: For employees with specialized knowledge, valid for up to 5 years.
  • Costs:

    • Filing Fee: $460 for Form I-129.
    • Premium Processing (Optional): An additional $1,440 to expedite processing to 15 days.
    • Additional Fees: May include fraud prevention and detection fees, varying based on specific circumstances.
  • Processing Time:

    • Standard Processing: Approximately 1 to 4 months.
    • Premium Processing: 15 calendar days.
  • Pathway to Green Card:

    • L-1A Holders: Eligible to apply for a Green Card under the EB-1C category for multinational executives and managers. This process typically does not require Labor Certification (PERM).
    • L-1B Holders: May transition to a Green Card under EB-2 or EB-3 categories, usually requiring PERM unless applying under a National Interest Waiver.

L-2 Visa: Dependents of L-1 Visa Holders

  • Eligibility Requirements:

  • Pathway to Green Card:

    • L-2 visa holders can apply for a Green Card, usually in tandem with the L-1 visa holder's Green Card application. This process involves filing Form I-485 for adjustment of status after an immigrant petition (Form I-130 or I-140) is approved.
